These Terms of Service govern your use of the Moon Mods website and purchases made from Moon Mods.

By accessing our website, placing an order or using our services, you agree to these Terms together with our Shipping & Fulfilment Policy, Refund, Cancellation & Returns Policy, Privacy Policy and, where applicable, our Warranty & Build Protection Policy.

1. About Moon Mods

Moon Mods is an independent watch modification business offering modified watches, watchmaking services, components, accessories and related products.

Trading as: Moon Mods

References to “Moon Mods”, “we”, “our” and “us” refer to the legal operator identified above.

2. Hand-Assembled & Modified Products

Many Moon Mods products are individually sourced, hand assembled, modified or configured to order.

As a result:

• sourcing and production times may vary;

• certain modifications may be irreversible;

• modification may affect warranties provided by an original manufacturer; and

• minor variations may occur between individually completed watches where reasonable for a hand-assembled product.

Estimated build and delivery times are governed by our Shipping & Fulfilment Policy.

3. Product Configurations & Third-Party Components

Moon Mods offers independently modified and assembled watches in a range of configurations.

The specific components, specifications and features included with each product are described on the relevant product page and confirmed by the configuration selected at the time of purchase.

Customers are responsible for reviewing their selected configuration before completing an order.

Moon Mods does not represent independently modified or assembled products as being manufactured, authorized or endorsed by any third-party watch manufacturer unless expressly stated otherwise.

4. Independent Modification & Third-Party Brands

Moon Mods is an independent watch modification company.

Moon Mods is not affiliated with, authorized by, endorsed by, sponsored by or otherwise commercially connected with Swatch Group, OMEGA, Swatch, Seiko, or their respective parent companies, subsidiaries or affiliates.

All third-party trademarks, logos, product names and intellectual property remain the property of their respective owners.

References to third-party brands are used to identify or describe donor watches, components, compatibility or products relevant to our independent modification services.

Such references do not represent sponsorship, endorsement, authorization or affiliation.

5. Orders

Submitting an order does not necessarily mean that Moon Mods has accepted it.

We reserve the right to refuse or cancel an order before fulfilment where reasonably necessary, including where:

• a product or required component is unavailable;

• pricing or product information contains a genuine error;

• we cannot complete the requested configuration;

• payment cannot be verified;

• we reasonably suspect fraud or unauthorized payment activity; or

• fulfilling the order would breach applicable law.

Where Moon Mods cancels an order for these reasons before fulfilment, amounts paid for the cancelled portion will be refunded as appropriate.

Customer cancellation rights are governed by our Refund, Cancellation & Returns Policy and applicable consumer law.

6. Pricing & Payment

Prices are displayed in the currency shown on the website and may change without notice.

The price applicable to an accepted order will ordinarily be the price shown when the order was submitted, except where there is an obvious pricing or technical error and applicable law permits correction.

Customers are responsible for ensuring they are authorized to use the payment method provided.

Moon Mods may use third-party payment processors, including services made available through Shopify.

7. Payment Disputes & Chargebacks

If there is a problem with an order, customers are encouraged to contact Moon Mods so that we can investigate and attempt to resolve the issue.

Nothing in these Terms restricts any lawful right to dispute a transaction through a bank or payment provider.

Where Moon Mods reasonably believes that a payment dispute or chargeback has been incorrectly or fraudulently initiated, we may provide relevant order, communication, tracking and fulfilment records to the payment provider when responding to the dispute.

8. Use Your Own Watch

By submitting a watch under our Use Your Own Watch service, you authorize Moon Mods to perform the modification selected in your order.

You confirm that:

• you own the watch or have authority to authorize its modification;

• you understand that some modifications may be irreversible; and

• modification may affect or void a warranty provided by the original manufacturer.

Moon Mods is not responsible under its voluntary warranty for pre-existing faults, damage or wear in a customer-supplied watch unless the issue is caused by Moon Mods.

Damage directly caused by Moon Mods during modification is addressed under our Warranty & Build Protection Policy.

9. DIY Kits & Customer Installation

DIY products are intended for customers choosing to perform their own modification or assembly.

Watch modification may require appropriate tools, technical ability and care.

To the extent permitted by law, Moon Mods is not responsible for damage caused by incorrect installation, unsuitable tools, misuse or work performed by the customer or another third party.

This does not limit any rights relating to a component that was itself faulty when supplied.

10. Product Information & Images

We make reasonable efforts to ensure that product descriptions, specifications, photographs and pricing are accurate.

Because Moon Mods products may be hand assembled and individually configured, minor differences in appearance, finishing or colour may occur within reasonable manufacturing and assembly tolerances.

Photography, lighting and screen settings may also affect how colours and finishes appear.

Nothing in this section permits Moon Mods to supply a product materially different from what was represented or removes rights provided by applicable consumer law.

11. Shipping, Customs & Delivery

Build times, shipping estimates, international fulfilment, customs responsibilities and delivery matters are governed by our Shipping & Fulfilment Policy.

Customers are responsible for providing accurate shipping and contact information.

International orders may be subject to duties, taxes, VAT, GST, brokerage fees or other import charges unless expressly stated otherwise.

12. Returns & Cancellations

Returns, change-of-mind requests, cancellations, faulty products and refused customs deliveries are governed by our Refund, Cancellation & Returns Policy.

Because many Moon Mods products are made or modified to order, change-of-mind cancellation or return rights may be limited once sourcing or production begins, except where mandatory local law provides otherwise.

13. Warranty & Build Protection

Eligible completed Moon Mods builds are covered by our separate 12-Month Warranty & Build Protection Policy.

Moon Mods' voluntary warranty is provided independently of any warranty offered by an original manufacturer.

Mandatory consumer rights may continue beyond the duration or scope of our voluntary warranty.

14. Moon Mods Intellectual Property

The Moon Mods name, branding, website design, original photography, written content, graphics, renders and other original materials are owned by or licensed to Moon Mods.

Except where permitted by law, Moon Mods materials may not be reproduced, copied, commercially exploited, distributed or used to create competing commercial materials without permission.

Nothing in this section claims ownership of trademarks, logos, designs or other intellectual property belonging to third parties.

15. Acceptable Website Use

You must not use the Moon Mods website:

• for unlawful or fraudulent purposes;

• to interfere with the security or operation of the website;

• to distribute malicious software;

• to collect information about other users without authorization;

• to impersonate another person or entity; or

• to infringe Moon Mods' or another party's intellectual property rights.

We may restrict access where reasonably necessary to protect the website, Moon Mods or other users.

16. Third-Party Services

Our website may use or link to services operated by third parties, including payment processors, couriers and social-media platforms.

Those services may be subject to their own terms and privacy practices.

Moon Mods is not responsible for the independent operation of third-party services to the extent permitted by applicable law.

17. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the maximum extent permitted by applicable law, Moon Mods will not be liable for indirect, incidental or consequential loss arising solely from circumstances outside our reasonable control.

Where applicable law permits liability to be limited, our liability will be limited only to the extent that such limitation is lawful and reasonable in the circumstances.

Nothing in this section limits mandatory rights relating to faulty goods or services, personal injury, fraud, deliberate misconduct or any other liability that cannot lawfully be excluded.

18. Privacy

Personal information is handled in accordance with our Privacy Policy and applicable privacy and data-protection laws.

Our Privacy Policy explains how information may be collected, used, stored or shared when customers interact with Moon Mods.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, operations, policies or applicable law.

The version applicable to an order will generally be the version in effect when that order was placed, except where a later change is required by law or expressly agreed with the customer.

The latest version will be published on our website with its updated date.

20. Governing Law

Subject to any mandatory consumer rights or laws that apply in the customer's country or region, these Terms and the relationship between Moon Mods and the customer are governed by the laws of NSW, Australia.

The parties submit to the courts having jurisdiction in that location, except where applicable law gives the customer a mandatory right to bring proceedings elsewhere.

21. International Consumer Rights

Moon Mods sells internationally.

Depending on your country or region, you may have mandatory rights relating to online purchases, cancellation, delivery, product quality, warranties, repairs, replacements, refunds or other consumer matters.

Nothing in these Terms or any Moon Mods policy excludes, restricts or modifies any consumer right or remedy that cannot lawfully be excluded. Where mandatory local consumer law provides greater protection, that law will apply.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will apply only to the maximum extent permitted by law.

The remaining provisions will continue to apply.
